IHC Takes Down PEMRA’s Notice Over Court Reporting
On Friday, the Islamabad High Court made a decisive move by restraining the Pakistan Electronic Media Regulatory Authority (Pemra) from initiating any detrimental actions against private television channels concerning their coverage of court proceedings. Meanwhile, in a separate legal development, the Lahore High Court embarked on a significant legal journey by issuing notices to both the federal government and Pemra. These notices were in response to petitions challenging the ban imposed on live coverage of judicial proceedings.
The order issued by IHC Chief Justice Aamer Farooq came during the hearing of a petition filed by the Islamabad High Court Journalists Association (IHCBA) and the Press Association of the Supreme Court. This petition contested a Pemra notification which had prohibited court reporting and broadcasting programs on sub judice matters. Barrister Umar Ijaz Gillani, representing the petitioners, argued that Pemra had misconstrued relevant rules and Supreme Court judgments in imposing a sweeping ban on covering pending cases. He vehemently criticized the notification, branding it as an assault on citizens’ access to information and their democratic rights.
The legal discourse surrounding this issue delved deeper into the intricacies of law and constitutional provisions. The counsel contended that the notification not only contradicted the Pemra Ordinance and constitutional provisions but also impeded the fundamental rights of citizens. Justice Farooq, after a preliminary hearing, issued notices to Pemra authorities, marking the beginning of a legal battle that could shape the landscape of media regulation in Pakistan.
In a parallel legal maneuver, the Lahore High Court, under the jurisdiction of Justice Abid Aziz Sheikh, took cognizance of the petitions challenging the ban on live coverage. Justice Sheikh recognized the importance of the questions raised in these petitions, acknowledging the necessity for a thorough examination of constitutional articles and regulatory provisions. The court proceedings saw arguments from Pemra’s counsel, Imran Arif Ranjha, who raised questions about the maintainability of the petitions. However, the petitioners’ counsel, Advocate Azhar Siddique, countered these arguments, asserting that the impugned ban was a result of political pressure on Pemra, highlighting concerns about the agency’s independence and adherence to legal procedures.
The legal saga surrounding media regulation in Pakistan continues to unfold, with both the Islamabad and Lahore High Courts playing pivotal roles in adjudicating on matters of significant constitutional importance. As the courts navigate through complex legal arguments and weigh the principles of freedom of the press against regulatory imperatives, the outcome of these legal battles remains uncertain, carrying implications for the future of media freedom and access to information in the country.
